What Types of Compensation Can I Receive?
According to Gregory v. Chohan, 670 S.W.3d 546, 556 (Tex. 2023), the compensation received by a person who successfully brings a personal injury lawsuit are known as compensatory damages. The purpose of compensatory damages in these lawsuits is to compensate an injured plaintiff by placing them in the same position they would have been in had they not been injured.

Special Damages
Special damages, which are also referred to as consequential damages, are damages resulting from the bad actor’s wrongful act. There are specific rules pertaining to special damages:
- Rule 56 of the Texas Rules of Civil Procedure requires anyone seeking special damages to state their claim for special damages with specificity when they file their lawsuit;
- Special damages are only awarded if they are foreseeable and directly traceable to the wrongful act that caused the injury; and
- Special damages cannot be speculative.
Special damages generally include things such as:
- Lost wages;
- Loss of earning capacity; and
- All reasonable and necessary medical expenses in the past, present, or future.
Punitive Damages
41.003 of the Texas Code allows injured people to recover punitive damages under appropriate circumstances. Punitive damages, which are sometimes referred to as exemplary damages, are awarded in addition to compensatory damages as a punishment. Punitive damages are generally only available in instances of gross negligence on the part of the bad actor, and they are capped under the statute.

Steps to Take After an Injury

1. Get to Safety
The first—and most important—thing to do after you are injured is to get to safety. Leave the dangerous situation in a calm, orderly manner to the extent possible. Nothing is more important than your safety and the safety of the other people involved in the injury-causing event. To the extent that you are able, try to abate the danger of the situation.
If your injury is caused by an automotive wreck or a trucking accident, report the incident to law enforcement after getting to a safe place. Once they arrive, law enforcement will create a report regarding what happened at the scene. It is imperative that they find a location of safety at the scene and remain there until the police arrive. It is illegal to leave the scene of an accident in Texas and in most other jurisdictions. Fully cooperate with law enforcement when they arrive.
2. Gather Evidence from the Scene
Once you have reached safety, try to gather what evidence you can from the scene of the injury. You can do this by:
- getting the names, contact information, and, if the injury is caused by an automotive accident, insurance information of everyone who saw what happened;
- take photographs of the scene of your injury, making sure to document the conditions of the location; and
- do not make any statement to anyone that could be considered an admission of guilt or responsibility.
3. See Your Trusted Physician for an Evaluation
If necessary, seek prompt medical attention from a professional to have yourself evaluated as soon as possible. Tell them what happened to cause your injury. Describe all of the symptoms you have experienced due to the injury, sparing no details. Your symptoms may progress or change as time passes from the incident, and you should continue to keep your doctor updated about them. To ensure that your injuries are properly documented, keep a medical diary journaling:
- The dates of your medical appointments;
- The treatments you received on each of those dates;
- Any consultation you received from your physician on each of those dates;
- How you are feeling and doing physically each day;
- Notes about how your injury has impacted you at work; and
- The dates that you missed work due to your injury.
Seeing your physician after the incident is important even if you do not feel immediate pain. Some injuries may not be instantly recognizable in the first few days after your injury. Your physician is the person best situated to diagnose and treat any injuries of which you are not yet aware.
4. Do Not Discuss the Injury or the Incident
Do not talk about the incident that caused your injury to anyone. While you might be tempted to discuss what happened, talking about the details of what happened could be damaging to your case down the road. For that reason, it is best that you speak only to your medical professional and trusted attorney about your injury and its cause after the fact.
5. Do Not Speak to the Insurance Company or the Defendant’s Lawyer
Often, insurance companies will seek to interview injured people after their insured causes someone to be seriously injured.
