Who Pays the Medical Bills After an Accident in Texas?

Wondering who pays your medical bills after an accident in Texas? Learn about insurance coverage, liability, and your options for compensation.

Fade OverlayWho Pays the Medical Bills After an Accident in Texas?

If you have been injured in a Texas car accident, you need to know who is responsible for paying your medical bills.

Texas is an at-fault insurance state, which means that the insurance company of the at-fault driver usually pays the medical bills of an injured party. However, you need to prove the other party is at fault.

Even if the fault is clear-cut, not all drivers are insured, and those who are may not have enough liability coverage for the damages you incurred.

If you have been injured in a Texas car accident caused by another party, our Dallas car accident attorney can help you pursue the compensation you deserve. Call (469) 977-7777 or visit our contact page to schedule a free consultation to discuss your case.

Texas Car Insurance Laws

Texas law requires drivers to have liability coverage for accidents they cause. The minimum coverage is $30,000 per person for injury, $60,000 per accident for injury, and $25,000 for property damages.

In many cases, the minimum coverage is woefully inadequate for the damages sustained.

What If the At-Fault Driver is Uninsured or Underinsured?

If an at-fault driver is uninsured or underinsured, you need to look elsewhere for payment of your medical expenses.

Other sources of payment for your medical expenses could include:

  • Check if you have purchased Uninsured/Underinsured Motorist coverage from your automobile insurer.
  • Check if you have Personal Injury Protection Coverage or Medical Payments Coverage. Your automobile insurer must provide Personal Injury Protection (PIP) Coverage unless you expressly decline it in writing. Medical Payments Coverage (MedPay) is an optional coverage offered by your automobile insurer. Both of these types of coverage can pay your medical expenses.
  • The at-fault driver’s employer may be liable if the driver performed their duties during the accident.
  • You can file a personal injury suit against the at-fault driver. The fact that they are uninsured or underinsured does not necessarily mean they don’t have assets to pay your damages.
  • Your health insurance coverage can cover your medical expenses after a Texas car accident but is subject to your deductible and copayments.

How Do You Prove Fault for a Texas Car Accident?

You prove fault in a car accident with solid evidence. Some types of evidence we use in motor vehicle accidents to prove fault include:

  • Eyewitness statements may offer an unbiased account of what happened to help support your claim.
  • Police reports can be used to provide an official, unbiased account of the accident, including a preliminary fault determination.
  • Photographs and video footage of the accident scene can provide evidence to help prove fault. This may include video footage taken by a party to the accident, dashcam video, or footage from nearby surveillance and traffic cameras.
  • Electronic data recording devices in the vehicles involved in the accident can provide excellent evidence of what happened to prove fault.
  • Expert witness reports and testimony from an accident reconstructionist can support your claim and help prove fault.

What If I Am Partially At Fault?

Texas follows a modified comparative fault rule, which means fault may be apportioned in an accident. The percentage of fault determines each party's financial responsibility.

If you are 50% or less at fault in the accident, you may still be able to recover compensation for your damages. However, if you are more than 50% at fault, you cannot recover compensation from the other at-fault parties.
